Definitions:
A. Illegal Drugs - Controlled substances as noted in Schedules I through V of Section 202 of the Controlled Substances Act (21 U.S.C. 812) and as further defined in regulation at 21 C.F.R. 1308.15. The term illegal drugs does not mean the use of controlled substances pursuant to valid prescriptions or other uses authorized by law.
B. Workplace - Any site where the performance of work for Rensselaer is done.
C. Conviction - A finding of guilt including a plea of nolo contendere or imposition of sentence or both, by any judicial body charged with the responsibility to determine violations of the Federal or State criminal drug statutes.
D. Criminal Drug Statute - A Federal or nonfederal criminal statute involving the manufacturing, distribution, dispensing, possession, or use of any controlled substance.
Policy:
A. The unlawful manufacture, distribution, dispensing, possession, or use of illegal drugs is prohibited in Rensselaers workplace.
B. As a condition of employment, employees must abide by this policy.
C. Rensselaer has established a drug-free awareness program which includes the following elements:
1. Employees have been informed of the dangers of drug abuse in the workplace via the Alcohol and Other Drug Education and Prevention Program Pamphlet.
2. Employees have been informed of available employee assistance programs.
3. Employees have been informed of Rensselaers policy of maintaining a drug-free workplace and the penalties that may be imposed upon them for drug abuse violations occurring in the workplace via the Alcohol and Other Drug Education and Prevention Program Pamphlet.
Sanction and Remedial Measures:
Employees who engage in conduct prohibited by this policy or are convicted of a criminal drug statute will be subject to discipline, ranging from documented verbal reprimand to discharge, or may be required to participate satisfactorily in Rensselaers employee assistance or a rehabilitation program.
Exempt and nonexempt employees will be disciplined according to the procedures contained in the Employee Conduct section. Faculty will be disciplined according to the procedures contained in the Handbook for Academic Staff. Student employees will be disciplined according to the procedures contained in the Student Handbook.
Responsibilities:
A. Employees - Rensselaer employees must: 1) comply with this policy; and 2) notify Rensselaer within five days after any conviction of a criminal drug statute occurring in the workplace.
B. Supervisors - Supervisory employees must: 1) participate in periodic training to assist them in identifying and addressing illegal drug use by employees; and 2) be cognizant of their responsibilities to refer employees who may be using illegal drugs on the job to Human Resources. Referrals to Rensselaers Employee Assistance Program are coordinated through Human Resources to assist both the employee and supervisor and to assure compliance with all applicable laws.
